TERMS OF SERVICE

These Terms of Service (“Terms”) govern your access to and use of the Hair & Makeup PROS website, platform, services, features, and related communications (collectively, the “Platform”).
By accessing or using the Platform, creating an account, making a reservation, registering as a PRO, or otherwise using Hair & Makeup PROS, you agree to these Terms and our Privacy Policy.
If you do not agree to these Terms, please do not use the Platform.
1. About Hair & Makeup PROS
Hair & Makeup PROS LLC (“Hair & Makeup PROS,” “PROS,” “we,” “us,” or “our”) provides an online platform designed to help clients discover and book independent hair and makeup professionals (“PROS”).
Hair & Makeup PROS is a technology and booking platform. We are not a salon, beauty-service provider, employer, staffing agency, or provider of the hair or makeup services booked through the Platform.
PROS listed on the Platform operate independently and provide services directly to their clients.
Nothing in these Terms creates an employment, partnership, joint venture, agency, franchise, or similar relationship between Hair & Makeup PROS and any PRO.
2. Independent PROS
PROS maintain their own independent businesses and are responsible for the beauty services they provide.
Hair & Makeup PROS does not control the manner or means by which a PRO performs hair or makeup services.
Each PRO is responsible for maintaining any licenses, permits, registrations, insurance, training, qualifications, or other requirements applicable to their services or location.
Clients are responsible for deciding whether a particular PRO is appropriate for their needs.
Hair & Makeup PROS does not guarantee the quality, style, safety, suitability, availability, conduct, or results of services provided by a PRO.
3. PRO Levels & Profiles
Hair & Makeup PROS may classify participating professionals into different PRO levels, including Student PRO, PRO in the Making, and PRO.
These classifications may consider information such as years of experience, education, professional experience, or other information supplied during registration.
PRO levels are intended to help clients understand the general experience level of professionals available through the Platform. A PRO level is not a guarantee, certification, endorsement, or promise of a particular result.
PROS are responsible for providing accurate and current information about their experience, qualifications, portfolio, services, location, and availability.
Hair & Makeup PROS may correct, remove, suspend, or request verification of profile information that appears inaccurate, misleading, inappropriate, or inconsistent with Platform requirements.
4. Client Matching & Availability
Hair & Makeup PROS uses information provided by clients and PROS to help identify professionals who may be available and appropriate for a requested service.
This may include:
event date and time;
location;
requested hair and/or makeup services;
onsite or in-studio service;
PRO availability;
service area or travel radius;
experience level; and
other booking requirements.
The Platform is designed so clients can view PROS who meet applicable booking criteria and are shown as available for the requested event.
However, availability displayed through the Platform is not an absolute guarantee against circumstances outside our reasonable control, including illness, emergencies, incorrect availability information, technical problems, or other unexpected events.
5. Accounts
Certain Platform features require an account.
You agree to provide accurate, complete, and current information and to keep your account information updated.
You are responsible for protecting your username, password, and other account credentials and for activity occurring through your account.
Please notify Hair & Makeup PROS promptly if you believe your account has been accessed without authorization.
Users must be at least 18 years old to create an account or enter into a reservation through the Platform.
6. Booking Services
When a client books a PRO through Hair & Makeup PROS, the Platform facilitates the connection and reservation between the client and the selected PRO.
Clients are responsible for providing accurate information regarding the event, services requested, location, timing, number of services, and other information necessary to complete the reservation.
Certain event types or services may have minimum booking requirements or other conditions displayed during the booking process.
By completing a reservation, the client agrees to the pricing, service requirements, cancellation terms, and other conditions presented at the time of booking.
7. Pricing & Payment
Hair & Makeup PROS establishes pricing and fees displayed through the Platform. Prices may vary based on geographic area, type of service, event type, PRO level, travel requirements, or other applicable factors.
Prices and fees may change from time to time. Any applicable price will be presented before a reservation is completed.
By submitting a reservation and payment, you authorize Hair & Makeup PROS and its payment service providers to charge the payment method you provide for the applicable amount.
Fees become final and non-refundable 24 hours after the reservation is made, except where otherwise expressly stated by Hair & Makeup PROS or required by applicable law.
Requests made within the initial 24-hour period are subject to the cancellation and refund conditions presented with the reservation.
Message delivery is subject to the capabilities and performance of your wireless carrier, and carriers are not liable for delayed or undelivered messages.
8. Cancellations, Changes & Unexpected Availability
We understand that plans and circumstances can change.
If a client needs to cancel or change a reservation, the applicable cancellation and refund rules will apply.
If a PRO becomes unavailable because of illness, emergency, scheduling issues, or other unforeseen circumstances, Hair & Makeup PROS may attempt to help the client locate another available PRO.
We cannot guarantee that a replacement PRO will be available.
Hair & Makeup PROS is not responsible for consequential expenses or losses resulting from a PRO's cancellation or inability to perform services, except to the extent otherwise required by law.
9. Onsite & In-Studio Services
PROS may offer services onsite at a client's location, from their own studio or approved workspace, or both.
Clients are responsible for reviewing the service location and booking information before confirming a reservation.
For onsite appointments, clients agree to provide a reasonably safe and appropriate working environment and access necessary for the PRO to perform the booked services.
PROS offering in-studio services are responsible for their own workspace and compliance with laws and professional requirements applicable to that workspace.
10. Client Responsibilities
Clients agree to:
provide complete and accurate booking information;
be available and prepared at the scheduled time;
communicate relevant service information to the PRO;
treat PROS respectfully;
provide safe and reasonable working conditions for onsite services; and
comply with applicable booking policies and service requirements.
A client's failure to be present, prepared, or able to receive the booked services may result in loss of the appointment without refund.
11. Communications, Email & SMS
By providing your email address or telephone number, you agree that Hair & Makeup PROS may contact you regarding your account, inquiries, reservations, appointments, service updates, customer support, and other transactional communications.
Where you separately consent to marketing communications, Hair & Makeup PROS may also send promotional email or text messages.
Message frequency may vary. Message and data rates may apply.
You may opt out of marketing SMS messages at any time by replying STOP. You may reply HELP for assistance or contact us at info@hairandmakeuppros.com.
Consent to receive marketing text messages is not a condition of purchasing services.
Additional information regarding our collection and use of personal information is contained in our Privacy Policy.
12. Testimonials & User Content
Users and PROS may be permitted to submit photographs, portfolio images, biographies, testimonials, comments, feedback, and other content (“User Content”).
You retain ownership of content that you own.
By submitting User Content to Hair & Makeup PROS for publication, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, display, format, resize, and publish that content as reasonably necessary to operate, display, and promote the Platform.
When submitting a testimony or other written feedback, you acknowledge that Hair & Makeup PROS may make minor corrections or edits for spelling, grammar, clarity, formatting, or length, provided such edits do not materially change the meaning of your statement.
You may not submit content that you do not have the right to use or that is unlawful, fraudulent, defamatory, threatening, harassing, obscene, deceptive, discriminatory, or infringing upon another person's intellectual-property or privacy rights.
13. Acceptable Use
You may not use the Platform to:
engage in unlawful or fraudulent activity;
impersonate another person or business;
harass, threaten, abuse, or discriminate against another user;
introduce viruses, malicious code, or other harmful technology;
attempt to gain unauthorized access to accounts, systems, or data;
scrape, harvest, copy, or systematically extract Platform information without authorization;
interfere with the operation or security of the Platform; or
use Hair & Makeup PROS intellectual property or Platform content for unauthorized commercial purposes.
We may restrict or terminate access for violations of these Terms.
14. Intellectual Property
The Hair & Makeup PROS name, logos, branding, Platform design, text, graphics, educational materials, software, functionality, and other proprietary content are owned by or licensed to Hair & Makeup PROS and are protected by applicable intellectual-property laws.
Except as expressly permitted, users may not reproduce, distribute, modify, sell, license, copy, or commercially exploit Hair & Makeup PROS content without written permission.
15. Third-Party Services
Hair & Makeup PROS may use or integrate third-party services for functions such as payment processing, communications, analytics, hosting, customer relationship management, social media, and other Platform operations.
Those services may be governed by their own terms and privacy policies.
Hair & Makeup PROS is not responsible for third-party websites or services that we do not own or control.
16. Privacy
Your privacy is important to us.
Our collection, use, storage, and disclosure of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.
By using the Platform, you acknowledge that you have had an opportunity to review our Privacy Policy.
17. No Guarantee of Beauty-Service Results
Hair and makeup services are inherently personal and subjective.
Photographs, portfolios, descriptions, testimonials, experience levels, and other information displayed through the Platform are provided to assist clients in making their own booking decisions and do not guarantee that a particular style or result will be achieved.
Hair & Makeup PROS does not warrant or guarantee the outcome of services performed by a PRO.
18. Disclaimer of Warranties
To the fullest extent permitted by applicable law, the Platform is provided on an “AS IS” and “AS AVAILABLE” basis.
Hair & Makeup PROS does not guarantee that the Platform will always be uninterrupted, error-free, secure, or available or that every PRO will remain available for every confirmed reservation.
Nothing in these Terms excludes warranties or consumer rights that cannot lawfully be excluded.
19. Limitation of Liability
To the fullest extent permitted by applicable law, Hair & Makeup PROS and its owners, officers, employees, agents, affiliates, and representatives will not be liable for indirect, incidental, special, punitive, exemplary, or consequential damages arising from use of the Platform or services arranged through it.
Hair & Makeup PROS is not responsible for the acts, omissions, conduct, negligence, representations, services, or service results of independent PROS.
This includes, without limitation and to the extent permitted by law, claims relating to personal injury, allergic reactions, property damage, theft, service quality, delays, cancellations, or disputes arising from services performed by a PRO.
Nothing in these Terms is intended to exclude or limit liability that cannot legally be excluded or limited under applicable law.
20. Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless Hair & Makeup PROS LLC and its owners, officers, employees, agents, and affiliates from third-party claims, damages, liabilities, losses, and reasonable legal expenses arising from your misuse of the Platform, violation of these Terms, violation of another person's rights, or unlawful conduct.
21. Suspension or Termination
Hair & Makeup PROS may suspend, restrict, or terminate an account or access to the Platform when reasonably necessary because of:
a violation of these Terms;
fraudulent or suspicious activity;
abusive or unsafe conduct;
misrepresentation;
misuse of the Platform;
failure to comply with Platform requirements; or conduct that could reasonably harm Hair & Makeup PROS, a client, a PRO, or another person.
Termination does not eliminate obligations or liabilities arising before termination.
22. Changes to the Platform or Terms
Hair & Makeup PROS may modify the Platform, its features, policies, pricing, or these Terms from time to time.
When we make material changes to these Terms, we may provide notice through the Platform, by email, or by updating the effective date displayed above, as appropriate.
Continued use of the Platform after revised Terms become effective constitutes acceptance of the revised Terms to the extent permitted by law.
23. Electronic Transactions
You agree that transactions, agreements, notices, disclosures, and other communications conducted electronically through Hair & Makeup PROS may satisfy legal requirements that such communications be in writing, to the extent permitted by applicable law.
When you affirmatively complete a reservation, registration, or other transaction after being presented with applicable terms, your electronic action may constitute your agreement to those terms.
24. Governing Law
These Terms are governed by the laws of the State of Washington, without regard to its conflict-of-law principles, except where applicable law requires otherwise.
To the extent legally permitted, disputes arising under these Terms shall be brought in the appropriate state or federal courts serving Cowlitz County, Washington.
Nothing in this provision eliminates rights or remedies that applicable consumer-protection law does not permit a consumer to waive.
25. Force Majeure
Hair & Makeup PROS will not be responsible for delays, interruptions, cancellations, or inability to provide Platform functionality resulting from circumstances beyond our reasonable control, including natural disasters, severe weather, fires, power or internet outages, governmental actions, labor disruptions, widespread technology failures, or similar events.
26. Severability
If any provision of these Terms is determined to be invalid or unenforceable, that provision will be enforced to the maximum extent permitted by law and the remaining provisions will remain in effect.
27. No Waiver
Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or our right to enforce it later.
28. Entire Agreement
These Terms, together with our Privacy Policy and any additional policies or booking conditions expressly presented through the Platform, constitute the agreement between you and Hair & Makeup PROS concerning your use of the Platform.
